1. What information do we collect about you?
When you visit our websites, we may automatically capture and record information about your visit, such as the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse movements) and methods used to browse away from the page. We may also gather technical device information, such as date, time, connection speed, IP address, browser type and version, operating system and platform. We (or our third party technical service providers acting on our behalf) may also use web beaconing technology to facilitate this information tracking. If you register for our music services, you will be asked to provide basic personal information so that we can create your account or send you a newsletter.
If you go on to make a purchase, you will be required to provide card details. The majority of payment details are not collected by 7digital but instead by our third party payment processor.
If you enter a competition, you may be required to provide additional personal information such as name, email address and/or address.
Information we receive from other sources, we may receive information about you if you use any of the other websites we operate or the other services we provide including the websites that we operate on behalf of our clients. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you , including but not limited to demographic information, from them.
If you register for an API Key, you will be asked to provide contact details as part of the application process.
2. How do we use your information?
This section sets out how we use your information at 7digital, transfer of your information to third parties is dealt with below.
Information on website use and any information we receive from other sources, is generally stored and analysed on an aggregated basis and used by us to monitor and improve the performance of our technology and the design of our website. For security reasons, some information may also be logged and kept for our internal security audit log, which may be linked to your IP address. Certain information on search criteria and results may be used to provide aggregated trend analysis for internal use. We may also use this to tailor our music intelligence services, to make suggestions and recommendations to you and other users of our site about goods or services that may interest you or them.
Registered user details, if you have registered for our Music Services we will principally use your information to provide you with the information, products and services that you request from us. Music rights holders also require us to tailor our product offering depending on where you are based. We may use your email address to send you service announcements, and to ensure that content from our website is presented in the most effective manner for you. We may also use information on listening and purchase history to provide aggregated trend analysis for internal use. If you have signed up to receive newsletters or marketing information, we will send information about goods or services we feel may interest you.
Payment information, is principally dealt with by our third party payment processor and will therefore only be used by us to check that it is a valid method of payment and to validate your location. Payment information is not kept by 7digital other than in anonymised form, to facilitate the provision of the services to you (for example, where you ask us to store your credit or debit card number for quick payment). You will always be able to remove any such stored payment details.
If you enter a competition, information you provide may be used to contact you about competition results, and further marketing purposes as notified at the time of data collection. We may also notify you that your personal information will be shared with specified third parties, as set out below.
3. Who do we share your information with?
Your registered details, in order to provide services to you we may share your information (and associated identifiable website usage data) with selected third parties, including:
- Business partners, suppliers and sub-contractors;
- Our third party payment processor, for the purpose of processing your payment details and purchasing music services from us;
- In certain circumstances (e.g. sale or purchase of business assets), or where we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or to enforce our Terms and Conditions; or
- to protect the rights, property, or safety of 7digital, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection
Marketing, where you choose to enter a competition or opt in to receive marketing information, we will share your data with third parties as set out below:
- Marketing: 7digital may allow you to choose whether to receive mailings from record labels and/or other promotional partners that we believe may be of interest to you. Such lists are strictly optional, on an opt-in basis and may be unsubscribed from at any time; and
- Competition entry, where we are running a competition in conjunction with a third party we will notify you at the point of collection that we will share you information such third party, and you will be able to choose whether or not to proceed.
Anonymised and aggregated data, we may also share your website usage, purchase history, or demographic data in an anonymised and aggregated form with:
- Analytics and search engine providers that assist us in the improvement and optimisation of our site;
- Advertising and affiliate networks that utilise the data to select and serve relevant adverts to you and others on our website or elsewhere;
- Music intelligence partners for the compilation of sales charts, and the analysis of data such as search criteria, results, downloads and purchases (for example, to provide search and recommendation services for music you might like).

7digital has implemented technology and security features, as well as strict internal guidelines, to safeguard the privacy of your personal information from unauthorised access or improper use. We employ SSL encryption to secure your personal data and payment information. We will continue to enhance our security procedures as new technology becomes available. While we make every effort to ensure that your information is secure on our system, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk.
If a particular Service requires you to open an account you will complete a registration process by providing certain information for use with that Service. You are responsible for maintaining the confidentiality of your password. You may have a credit card or other payment method stored with 7digital’s payment processor, and if your password is used by a third party (whether or not authorised) the third party will be able to make purchases with that payment method. You will be fully liable for any actions made with your account details where you have not kept your password secure. 7digital advises you to change your password frequently and to always keep it secure.
You agree to immediately notify us of any unauthorised use of your account or any other breach of security. In no event will 7digital be liable for any indirect or consequential loss or damage resulting from the disclosure of your user information. If you believe someone has accessed any service using your user information without your authorisation, it is your responsibility to set up a new password or contact us to delete your account.

Without limiting any provision herein, 7digital makes no warranty that any particular computer, portable device, or other hardware will be compatible with 7digital’s Website. It is your sole responsibility to ensure that your playback system(s) will function correctly with the application.
7 INTERNATIONAL USE
You agree to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet.
8 INTELLECTUAL PROPERTY RIGHTS
8.2 Posted Material. 7digital does not claim ownership of any materials you post, upload or submit to any publicly accessible area of the Website. However, by doing so you are granting 7digital a world-wide, royalty free, non-exclusive licence to copy, distribute, transmit, reproduce, publicly display, edit, translate or publish such content for as long as you elect to display such content via the Website. The licence shall be terminated when such content is deleted from the Website.
9 LOSS CAUSED TO US
You agree to cover and repay any loss suffered by 7digital in the event that you breach these Website Terms, and a claim or demand is brought against 7digital, arising out of your use of the Website and/or any content submitted, posted or transmitted through the Website, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by 7digital in consequence of your breach of these Website Terms.

The company was founded by Ben Drury and James Kane, offering digital music delivery B2B services. In the year following, 7digital was powering 180 stores for record labels and brands. Our fastest release ever was 46 mins from on-stage performance to sale in Dec 2005 as part of the Live 8 Guinness World Record.
7digital was powering 1,000 stores and made history by enabling Koopa to become the first unsigned act to make it into the top 40 charts on downloads alone. 7digital-powered service Now Play It won “Best Digital Service” award at the BT Digital Music Awards. 7digital signed a partnership with Last.fm and celebrated their first 1 million users on the platform. In 2008 7digital launched the global API and became the first European download store to offer Warner Music catalogue DRM-free.
7digital launched HMV music and video download stores in the UK and Canada, as well as an e-book store for Waterstones. Lost Tunes, powered by 7digital, won the ”Digital Achievement of the Year“ award at the Music Week Awards. We partnered with Songbird to provide an integrated MP3 store and built a mobile app on BlackBerry, which won the EMEA ”Innovation Award“. 7digital integrated MP3 downloads into AOL’s Winamp media player, HMV Group acquired 50% stake in 7digital for £7.7 million, we took part in the first ever Music Hack Day in London and celebrated 7 million tracks our catalogue.
7digital partnered with Shazam, we launched our own Android and iOS apps and developed a unique digital music experience for Samsung devices. Network operator O2 chose 7digital as their digital music partner in the UK and 7digital’s API powered services for 120 clients with 500 million API requests served.
In the following years 7digital expanded North American operations with key hires and launched Samsung Music Hub 3.0 in numerous territories. 7digital was selected as the music partner for Toshiba connected TV and we released the first digital music store on Windows 8.
7digital merged with award-winning radio company, UBC Media and went public on the LSE. We launched hi-res download stores for Panasonic and Onkyo, a Latin music radio service for SBS (Spanish Broadcasting System) and we confirmed a partnership with will.i.am.
7digital powered the launch of The Overflow, a genre-based streaming app, and we expanded territories for Radioplayer Worldwide. We announced that we are powering services for OpenLIVE, Tonlist, Electric Jukebox, Team Rock, CrowdTunes, Rithm, and Astro. We expanded licenses to Africa making our reach a total of 82 territories. Finally, we launched an integration with Google Cast to playback hi-res audio.
7digital started the year by premiering MQA content on onkyomusic at CES. We announced a new contract to power the relaunch of eMusic and won the tender to produce Jazz programmes for BBC Radio 3. We acquired French B2B streaming service Snowite (now 7digital France) and have brought on a number of new key hires. We launched 7digital Creative to look after curation, radio production, editorial and playlisting services for our partners.
